In most HOAs, the responsibility depends on property ownership and the HOA's governing documents:
✔️ If the abandoned house is still privately owned, the homeowner is generally responsible for maintaining the lot, yard, and exterior areas, even if they no longer live there.
✔️ If the property has been foreclosed on, responsibility may shift to the bank, lender, or entity that now owns the property.
✔️ If the outdoor area is considered HOA common property, then the HOA is responsible for maintenance.
When an abandoned property becomes overgrown, attracts pests, or creates a safety concern, the HOA may:
📋 Send violation notices to the owner of record.
🎯 Perform the maintenance if governing documents and local laws allow.
💰 Charge the costs back to the owner and potentially place a lien on the property.
