Photograph the unit after the tenant hands it back to you and before any repairs or any cleaning. You plan to charge tenant for. Then photograph it again after the work. Both sets need to go to the tenant with the itemized statements. These 15 minutes with your phone before anybody else walks in can save you a lot of time and headache in the future. check out the full video on my YouTube page.

Your tenant moves out, the unit's rough, so you get it cleaned fast because you want it rented again. Totally reasonable. Also, you just deleted your own evidence.
In California you have to photograph the unit before any cleaning or repair you plan to charge for, and again after. Skip it and that deduction is standing on nothing.
That is one of three move-out mistakes I see constantly, and the third one is the one landlords argue with me about. New video is up. Link's in the comments.

California move out security deposit rules trip up more self-managi...

Let’s say the deposit was $2000 and you kept $600 of it for damages. You totally believe and can prove the damages happened, but you’re disposition statement went out a couple of days late. Now you could lose your entire claim. The whole $2000 and up to $4000 and statutory damages plus actual damages. If if a judge feels you acted in bad faith. Check out the full YouTube video on the five mistakes that gets you in trouble in court.

The burden approved, sits on you as the landlord. That means every photo, every receipt, every hourly rate you wrote down. Isn’t you just being thorough. It’s the evidence you need if your case, Ever ends up in front of the judge. And on top of that a judge, kind award, bad damages, whether not even check out the full video on the channel.

21. Calendar days not business days is what you need to remember as a landlord on the 21. Both the deposit refund and security deposit disposition statement must be out of your hands. If not, you could be on the hook for more than you bargained in front of the judge. See the full video breakdown on my YouTube channel.

The deduction was reasonable. The landlord still lost.

That is the pattern in most California security deposit cases, and it catches experienced owners as often as new ones. Civil Code 1950.5 does not just govern what you can deduct. It governs the sequence you have to follow to deduct anything at all.

Five failure points account for most of the exposure:

1. The 21 calendar day deadline for the itemized statement and the remaining deposit. A bad faith failure here can cost the landlord the claim to the entire deposit, not just the disputed portion.

2. Deductions for ordinary wear and tear, preexisting conditions, or the cumulative wear of multiple prior tenancies. The last tenant is not chargeable for eight years of use.

3. An amount sent without the supporting documentation. Invoices, receipts, a description of in house labor with time and hourly rate, and the required photographs all travel with the statement.

4. The skipped pre move out inspection notice. Where an inspection is conducted, deductions that were not identified on that written list generally cannot be taken later.

5. The wrong return method. Where rent or the deposit came in electronically, the refund generally has to go back electronically absent a written agreement otherwise.

The rule underneath all five: the landlord carries the burden of proof as to the reasonableness of every amount claimed. Statutory damages run up to twice the deposit, in addition to actual damages.

Full breakdown of all five, with the documentation habit that prevents most of them, in the new video.

California Lo says you can’t charge one tenant for where that builds up across multiple tendencies. So the carpet went in nine years ago, four different households have used it, and now, but finally it looks bad on this tenant‘s watch. This is just the tenant who happened to be standing there the day you decided to replace it. You can’t handle them the full replacement bill I know! It feels like that last person should pay for how it looks now. But the loss says no. What you get to recover is the piece this tenant actually cost. Not the nine years they’re actually three more rules like this one full video walk-through is on our YouTube channel.

The rent was $2000. The deposit was $2000. The tenant moved out and the landlord charge $400 for carpet and paint. They didn’t have any move out photos and only one line on a piece of paper. The tenant decided to file in small claims court and if the judge finds that they withheld the deposit in bad faith, the landlord doesn’t just lose the 1400. They lose the right to claim any of that deposit so the $2000 goes back to the tenant. And statutory damages can run up to twice the deposit on top of that 4000 more than the deposit itself. So $6000 over missing photos. My whole video on my YouTube channel goes through this exact scenario and how to protect yourself as a landlord.

In a California security deposit case, the landlord has the burn of proof on whether the charge was reasonable. Not the tenant. You. So when you take $400 out for carpet and the tenant pushes back, the question in that room isn’t whether they can prove it was normal wear and tear. It’s whether you can prove it wasn’t. Photos before they move in photos after they handed back the keys before anybody cleans photos after the work. Invoices. 21 days. That’s not paperwork that’s your case. Ever wondered what counts as “normal wear and tear” in California? Spoiler: the law doesn’t spell it out. But if you’re charging for repairs, you have to show it’s fair. I just made a video explaining where the line really is—so you don’t get caught off guard.
