October snapshot for inherited homes in Jacksonville: the median price held at $399,000, days on market stayed at 31 to 36, and one in five contracts canceled. Prices did not move; the weak deals did.

If your parent lived in another state and the house is in Florida, there are going to be two probate cases, and that surprises almost every family. The main case opens in the home state. The Florida house needs its own case here, with a Florida attorney, because a Florida house can only pass through a Florida court.

Your home-state attorney cannot file it. Ask on the first call whether they have a Florida attorney they work with. If not, I can introduce one.

If your parent lived in another state but owned a house in Florida, you'll probably hear the word "ancillary."

The main probate happens in the state where they lived. The Florida house is Florida real estate, so Florida usually needs its own case just for the house. That's ancillary probate: two courts, two sets of paperwork, and usually a Florida attorney.

It's the first thing I ask an out-of-state family, because the house can't close until someone has authority to sign in Florida.

Halloween week at an inherited house. The three things that actually scare families: no will, three heirs who do not speak, and forty years of stuff. All three are fixable.

Two clocks run on every inherited house. The court's clock runs in months. The house's clock runs every single day, in taxes, insurance, and Florida humidity.

The mistake families make is waiting for the first clock to finish before they touch the second. Cleanout, repairs, pricing, and photos can all happen while the court does its work, and the house can usually go on the market once the personal representative is appointed. The closing date sits behind the court's last step.

Florida probate has two clocks, and only one belongs to the court.

The court clock: the Florida Bar's consumer pamphlet says even a simple estate must stay open at least three months for creditor claims, and five or six months is a reasonable expectation.

The house clock: the contents, the condition, the price. That work can run at the same time. Once a family is moving, I'm usually start to finish in 60 to 90 days.
