A road can lead somewhere. But does the legal right to cross the land exist?
In 1979, a Wyoming property dispute reached the U.S. Supreme Court. The case involved a road cleared across privately owned land to reach public property near Seminoe Reservoir.
The question was whether an old federal land grant gave the government the right to build that road. The Court ruled that the government did not have the claimed implied easement under the original land-grant law.
It’s a reminder that the history behind a property can be more complicated than what we see on the ground. Deeds, easements, rights-of-way, and other recorded documents can all be relevant when reviewing property history.
