East Bay Eric I am a Realtor. I am a San Franciscan, now living in the East Bay. I am a lover of great meals.

I was born in San Francisco. I went to grammar school in Corte Madera, high school in San Francisco, and earned a BA in English Literature from Cal Berkeley. I have lived in London and traveled through Europe, Northern India and Southeast Asia, but I have always returned home to the Bay Area. I now lives in El Cerrito. I was trained as a baker, and I have worked in many restaurants and bakeries in Berkeley and Oakland. I was also a member of Berkeley’s Cheese Board Collective for 6 years. In 2002, I found my calling, Real Estate. I am passionate about the goals and needs of my clients. It is important to me to bring understanding and control of a complicated process to my buyers and sellers. These are the local government issues affecting property owners in Oakland and Berkeley this month.

CITY OF OAKLAND

Repeal of Rent Control Exemption – Owner Occupied Duplexes/Triplexes – Continued to 2/26/19 City Council

After the November election, owner-occupied duplexes and triplexes are now subject to Oakland’s just cause ordinance. However, these owner-occupied properties still enjoy some flexibility with an exemption from rent control if the owner lives in the property for two years. OBAR provided testimony at numerous hearings and the last City Council meeting. The item was continued to February 26th amid legal concerns, possibly related to one councilmember’s ownership of rental property. OBAR will provide further notice as we get closer to the next City Council Meeting.

Soft-Story Ordinance

Seismic retrofit will be mandated on certain buildings in the City of Oakland. This legislation follows similar ordinances enacted in San Francisco, Berkeley and Alameda. 1,479 buildings have the potential of being required to undergo seismic retrofit work.

Seismic retrofits are considered capital improvements under the City’s Rent Adjustment Program (RAP). Under existing RAP regulations, up to 70 percent of the cost of the capital improvement may be passed on to the tenant. The proposed ordinance directs the Housing, Residential Rent and Relocation Board (“Rent Board”) to approve an amortization schedule for the pass-through of mandatory seismic-related capital improvement costs to tenants.

The retrofit program would occur over a six-year period. Larger building will be required to complete retrofit work at the beginning of the six-year period. OBAR will provide further notice regarding updates to the Alameda County D&DA and other Forms to address this issue.

Vacant Land Tax

Oakland’s Vacant Land Tax passed despite OBAR’s best efforts. A blanket notice has gone out to all non-owner-occupied residential properties and all non-residential property owners. The finance department will be developing implementation strategies between now and April and we should expect an ordinance to come to City Council around May. We will be monitoring this process and providing feedback on a continuing basis.

Public Lands Policy
City Council has directed staff to draft an ordinance that would require 100% of proceeds from public land sales to go toward affordable housing, offer any land for lease to affordable housing developers first, and require project labor agreements with local trade unions for developments over 80 units or $40 million.
The city claims they have around 24 acres of land that is suitable for development. We are monitoring and will provide updates.

Oakland Downtown Specific Plan

A preliminary draft plan that will guide development and growth in the downtown area has been released.

The document identifies potential goals, strategies, projects and programs to achieve a new vision of inclusion, celebration and opportunity. Public comments will be gathered at community events and meetings through February and will be incorporated in the Draft Specific Plan anticipated this summer. Help prioritize strategies for downtown’s economic development, culture, housing, transportation, environment and infrastructure by giving feedback at a meeting or submitting comments to:

CITY OF BERKELEY

Inclusionary Housing Requirement Amendments – 2/19/19 City Council

A few councilmembers are concerned that project applicants are avoiding inclusionary affordable housing requirements by modifying property lines so that no lot is large enough to fall under the inclusionary housing requirements. The report on the item did not state how many times these modifications occurred if ever. OBAR will be monitoring.

Assessment of Vacant Property – 2/19/19 City Council

The City might be asking the City Manager to develop a plan to identify 3,754 alleged “vacant housing units.” This will be discussed at the 2/19/19 City Council Meeting. This may lead to some form of encroachment on private property. OBAR will be monitoring this closely.

Measure P and O Funding Implementation

Measure O was a $135 Million bond that passed in November and is being considered to fund the following:

A) Housing Trust Fund Expansion ($115M)
B) Small Sites Loan Program ($12M).
C) Accessory Dwelling Unit (ADU) Conversion Loan Program ($4M).
D) Expand Senior & Disabled Rehabilitation Loan Program to Qualifying Low Income Families ($4M)

Measure P Funds: Plans to spend this money are a bit vague. The Association will be updating membership on an ongoing basis.

Storm Water Infrastructure

The Berkeley Community Environmental Advisory Commission has made onerous recommendations regarding property owner responsibilities for storm water capture. City Staff has stated that they oppose the recommendations. City Council directed this to a newly formed City committee for further discussion. We are monitoring this closely

Congratulations to our amazing clients, Alexandria and Sophie!!! Corinne and I got these great buyers into a fabulous, off-market, all new construction home.
