What happens when a key recruitment route for non-EU workers is suddenly put on hold?
In Romania, this is no longer a hypothetical question. Following a legal action challenging the list of shortage occupations, the enforcement of Order no. 1073/2026 was suspended. As a result, the WorkinRomania.gov.ro flows for employer registration, employer authorisation and the submission of single applications for D/AM2 work visas have been deactivated.
The next court hearing is scheduled for 2 December 2026, at 09:00. However, this does not necessarily mean a final decision will be issued on the same day, and any first-instance solution may still be subject to appeal.
Until the situation is clarified, employers relying on the D/AM2 route are facing uncertainty in recruitment planning, staff mobilisation and operational timelines. For businesses that need talent from outside the EU, this is a moment to review recruitment plans carefully and assess, case by case, what legal options remain available.
