A boundary dispute is not resolved by deciding which landowner's fence, building, or personal claim appears more convincing.

The surveyor's task is to investigate the available boundary evidence, reconstruct the relevant survey framework, measure the ground, and clearly identify where the evidence agrees or conflicts.

The investigation begins with the records for both parcels.

The surveyor obtains the relevant survey plans, title or deed descriptions, cadastral records, previous survey information, coordinates, bearings, distances, and details of any monuments shown at the disputed boundary.

Both parcels need to be examined.

The surveyor should not investigate one property in isolation when the disputed area involves two adjoining claims.

The next stage is field reconnaissance.

The surveyor searches for boundary beacons, concrete monuments, iron pins, pegs, fences, walls, occupation lines, buildings, roads, and other physical evidence that may provide information about the original or existing boundary.

Recovered survey monuments are particularly important because their positions can be measured and related to the documented survey framework.

The surveyor then establishes appropriate survey control and observes the relevant evidence.

GNSS, total station traversing, or other suitable methods may be used to determine the positions of the recovered monuments and disputed features.

The measured positions are compared with the recorded boundary information.

Distances and bearings between known points are checked.

Parcel dimensions are reconstructed where appropriate.

Coordinates are compared within the applicable reference system.

The surveyor also examines whether the two adjoining surveys are actually based on the same coordinate framework and datum.

A difference between two coordinate sets does not automatically mean that one landowner is occupying the wrong land. Older surveys may have been produced using different control, datums, or surveying methods.

Occupation evidence is also documented.

For example, a fence may have been constructed away from the surveyed boundary, while a building may extend across a claimed line.

The surveyor records these conditions rather than assuming that physical occupation automatically establishes the legal boundary.

If the evidence conflicts, the surveyor does not simply choose the boundary that produces the smallest difference.

The conflicting evidence is documented, analyzed, and reported according to the applicable cadastral and legal requirements.

Where a formal legal determination is required, the surveyor provides the technical survey evidence, while the appropriate legal authority determines the legal rights arising from that evidence.

The final survey documentation should clearly show the evidence examined, measurements obtained, recovered monuments, competing boundary positions, discrepancies, and the basis for any professional boundary determination the surveyor is authorized to make.

The strength of the investigation comes from being able to trace the conclusion back to records, monuments, measurements, and a consistent survey framework, rather than relying on statements from either landowner.

Here is something to think about:

When two adjoining landowners present different documents and both claim the same strip of land, should the surveyor begin by measuring the disputed areaβ€”or first reconstruct the boundary evidence that established both parcels?
