When a property is inherited without a Will, it does not simply change hands overnight. There is a clear process for establishing who inherits it and putting the ownership records in order.
The first step is to establish who is legally entitled to inherit the property. The answer depends on the family and the law that applies to them. For Hindu families, for example, the law sets out who inherits and how the property is divided. Other personal laws have different rules.
The next step is to put the necessary documents together — including the death certificate, existing property papers and documents establishing the legal heirs.
There is also a term that often causes confusion: “Succession Certificate.”
A succession certificate is generally used for recovering debts and dealing with securities of the deceased. It is not the document that transfers ownership of a house, flat or land.
For a property within Kolkata Municipal Corporation, the relevant records may then need to be updated through mutation on succession with KMC. Mutation is a record update; it does not, by itself, create ownership. The underlying ownership documents still matter.
If there is more than one heir, their respective shares need to be established clearly. This becomes particularly important if the family later wants to sell, transfer or divide the property.
And importantly, not every case requires going to court.
If the documents are in order, the ownership is clear and there is no disagreement, the process can be dealt with through the appropriate documentation and applications. Legal advice becomes important where there are missing documents, questions about ownership or different claims within the family.
Some cases are straightforward. Others take longer.
The important thing is to understand the process rather than assume that it will be complicated.
For families holding valuable property over generations, understanding how ownership passes from one generation to the next is an important part of owning property responsibly.
Better property decisions begin with better understanding.
