🏡 Do you have a private-use terrace? Here’s what you need to know: just because you use it doesn’t mean you own it!

This is one of the most common questions when buying a property, especially penthouses and ground-floor apartments.

👉 A terrace for exclusive use may still be a communal property. This means it belongs to all the owners in the building, but the right to use and access it exclusively is assigned to one property owner, usually because it is attached to a penthouse or ground-floor apartment.

So, what does this mean in practice?

🔹 Ownership matters.
Always check the property deeds, the building’s constitutive title and the community regulations. These documents help establish who owns the terrace and what rights and obligations apply. Its use is also governed by Spain’s Horizontal Property Law and the community’s rules.

🔹 Everyday maintenance is usually your responsibility.
Cleaning, looking after plants and dealing with minor damage caused by everyday use will generally fall to the person who enjoys the terrace.

🔹 What about damp, leaks or structural problems?
The owners’ association is generally responsible for structural damage, issues affecting the building’s framework or slab, and general waterproofing — such as repairing the waterproof membrane if leaks occur — provided the damage has not been caused by improper use.

🔹 Thinking of enclosing it, adding a pergola or making alterations? 🚨
You cannot necessarily do this freely. If the changes affect communal elements or the building’s façade, approval from the owners’ association and compliance with applicable regulations may be required.

💡 Our advice before you buy: Don’t rely solely on what the seller or property listing tells you. Check the deeds and the building’s legal documentation to understand exactly what rights you are acquiring.

Because a terrace can be for your exclusive use… without being your exclusive property.
