Price agreed? The deal isn't done yet. What every Cyprus property buyer and seller should know🏡
Shaking hands on a price feels like the finish line, but it's only the start. Most problems appear between the reservation and the title transfer. Here's what to have clear before you sign or pay.
1️⃣ A "reservation agreement" can be binding
Even a one-page form that takes a property off the market can create obligations. Before signing, check the parties, the price, who holds the money, the reservation period, and what happens if the main contract is never signed.
2️⃣ Deposits aren't automatically refundable
Whether you get it back depends on what's written and why the deal fell through. Verbal promises won't protect you if the paperwork says otherwise.
3️⃣ Signing ≠ owning
A contract of sale gives you contractual rights. Ownership passes only when the transfer is completed at the Department of Lands and Surveys.
4️⃣ The 5-working-day rule
For contracts signed from 12 December 2023, the seller must attach a search certificate dated no more than 5 working days from signing. If the signing slips, you'll need a fresh one.
5️⃣ Deposit your contract at the District Lands Office
This registers the buyer's claim on the property and strengthens protection if the seller fails to complete. The general deadline is 6 months from signing. Don't leave it to the last week.
6️⃣ Mortgages and missing title deeds aren't deal-breakers, if handled properly
A mortgaged property can be sold, provided the bank release is agreed and written into the contract. Buying without a separate title deed is common in Cyprus, but you need to know why the title hasn't been issued and how you'll get it.
7️⃣ Budget update: no more stamp duty
Stamp duty no longer applies to documents drawn up and signed from 1 January 2026. You should still budget for legal fees, transfer fees, VAT where applicable, and clearances.
✅ Bonus: Buying or selling from abroad? A properly drafted power of attorney lets you complete without flying in.
