Got a tenant problem that isn’t about rent? That’s Form N5 territory, and small mistakes get files thrown out.
The N5 covers three things: substantial interference, wilful or negligent damage, and overcrowding. Here is where I see Ontario landlords trip up most:
1. Filing too early. On a first N5 the tenant gets 7 days to fix the problem. Fix it, and the notice is void. You can’t apply to the Landlord and Tenant Board until day 8.
2. Mixing up the second N5 rule. A second N5 is only non voidable if new conduct happens more than 7 days but less than 6 months after the first one.
3. Weak evidence. Dated photos, logs and repair estimates win hearings. Opinions don’t.
4. Missing the deadline. Apply no later than 30 days after the termination date on the notice, or you start over.
5. Self help. Changing locks or cutting services is unlawful. Only the Board can order an eviction.
