Off the plan purchases are exciting. A brand new home, built to your specifications, before it even exists.

But they come with a unique set of risks that most buyers aren't fully aware of.

Here's what makes buying off the plan different - and why experienced conveyancing matters even more.

THE CONTRACT IS COMPLEX - off the plan contracts are often lengthy and heavily weighted in favour of the developer. Special conditions, sunset clauses and variations clauses need very careful review.

THE SUNSET CLAUSE - this is a date by which the property must be completed and settled. If it isn't, either party may have the right to pull out of the contract. Understanding how your sunset clause works is critical.

THE FINISHED PRODUCT MAY DIFFER - developers can make changes to materials, finishes and design during construction. Your contract should specify what's locked in and what can change.

STAMP DUTY IS CALCULATED DIFFERENTLY - in some cases, stamp duty on an off the plan purchase is calculated on the land value only, which can result in a significant saving. This is worth understanding early.

SETTLEMENT IS TRIGGERED BY COMPLETION - you don't settle on a fixed date. You settle when the developer notifies you the property is ready - which could be months or years away.

If you're considering an off the plan purchase, we'd love to review the contract before you commit.
