Does your childcare lease let the landlord end it early to demolish or redevelop? If a state retail leasing Act applies, it adds rules: in Queensland and Victoria, a genuine proposal, at least six months' notice, and compensation for your own fit-out. But in Queensland a freestanding centre isn't covered by that Act at all. We've compared three states.

Have you ever checked whether your lease is a retail lease?

Can a landlord end a childcare lease early to demolish or relocate? It depends on the lease and whether a retail leasing Act applies. Qld, Vic and NSW compared.

A tablet with children's medical details goes missing from the room. What happens next? Under the Privacy Act, a centre that suspects a data breach must take all reasonable steps to assess it within 30 days, and the $3 million small-business exemption doesn't help a centre that holds health information. We've set out the steps in order, with the section for each.

Who at your centre would be the first to hear about a lost device?

A childcare centre holding children's health information is covered by the Privacy Act whatever its turnover. What APP 11 requires, and the 30-day breach steps.

Buying a leasehold childcare centre in Queensland? The fire-safety maintenance duty is the occupier's, and under the Fire Services Act that includes the tenant running the business. In NSW and Victoria it's the building owner's. Either way, the day you settle, any defect still open is yours to fix. We've set out what each state requires and the documents to ask for first.

When you last bought or leased a building, did anyone hand you its fire-safety records?

Buying a childcare centre? The fire-safety duty sits with the owner in NSW and Victoria and the occupier, tenant included, in Queensland. What to ask for.

Funded a childcare centre with a partner who runs it day to day? You're entitled to see the register of members and the members' minutes for free, and with 5% of the votes you can make a small company prepare and send you a financial report. The books themselves take the directors' permission or a court order. We've set out every step, with the deadlines.

If you co-own a centre, what do you actually receive from it each year?

A shareholder who doesn't work in the centre can see the register and members' minutes free, demand a financial report with 5% of the votes, and reach the books by permission or court order.

One enrolment agreement signed on a Tuesday sets four deadlines: the enrolment notice, the first session report, the family's statement, and the last day you can fix that report yourself. We've put every CCS reporting deadline a provider has into one table, with what happens when a report is late or wrong.

Which of these deadlines does your centre find hardest to hit?

CCS session reports are due 14 days after each week and enrolment notices 7 days. Every provider deadline under the Family Assistance Law, and why a late fix is still a breach.

Buying a centre rated Exceeding? Good news: nothing in the National Law resets the rating when the service approval changes hands. Less good news: nothing locks it in either. We've set out what travels with the centre, what the regulator can change after settlement, and how to price the difference.

What did the rating count for in the last centre you looked at?

Got a letter from the regulator? Whether it's a compliance direction, a compliance notice or an emergency action notice changes your deadline, your review rights and whether it ends up on a public register. We've set out all four in one table, plus what a buyer should ask for when the register comes up clean.

Which of the four have you come across?

Selling your childcare centre? Some of your records will stay with you long after the keys go. On settlement day, only the files of children enrolled that day move to the buyer, and only once a parent has consented. Incident records are kept until the child turns 25. We've set out every record, how long it lives, and who holds it.

Does your sale contract say who keeps the archive?

Building a childcare centre? The contribution conditions on your consent can fall due before the first sod is turned. In NSW's four HPC regions, the state Housing and Productivity Contribution must be paid before the first construction certificate — on top of the council's own contribution or levy. Queensland prices childcare in its own regulation row and collects later. We've set out all three states, stage by stage.

Is the contributions line in your feasibility dated, or just costed?

The NSW workers compensation "freeze" holds the scheme's rates — not your premium. Your bill still moves with your wages and your claims. We've set out how a childcare centre's premium is actually built in NSW, Victoria and Queensland: the 2026-27 childcare rate in each, the point where your own claims start to count, and the new two-week excess on NSW claims.

Do you know which side of your scheme's threshold your centre sits on?
