The document at this link is 53 pages; 10 pages are the Code itself. The other pages are the administrative provisions, definitions, fee, and penalties.

The Code is scheduled to take effect May 14, 2016, 180 days after City Council adopted the Code. After one year of having the Code in effect, a review will be scheduled. I anticipate the review will occur in June 2017 at the earliest; likely July or August. I encourage you to take and keep notes on what part of the Code works and what does not, including what does not need to be in the current code and what is missing (carbon monoxide detectors are not in the Code, but in my opinion should be listed). Do not wait until you receive the notice of review to begin planning your comments. Be able to provide specific examples; it matters.

There are a couple of things in particular that I want to note:

First, there are elements of the Code that holds the tenants responsible (trash/solid waste littering the exterior of the property, indoor furniture left outside – the couch issue, for a couple of examples). Penalties for these tenant-caused infractions would be assessed to the tenants, not the landlord.
Second, under the current Rental Housing Code, only a tenant with a current rental agreement could file a complaint with the City (or their agent, most often their parent). Under the Livability Code, ANYONE can file a complaint, including former tenants, landlords, parents, neighbors, adult children, city and county employees, etc.
Third, the Livability Code is applicable to the exterior of all structures in the Corvallis city limits (owner-occupied houses, rentals, commercial buildings, etc), as well as vacant land. The Code applies to both the interior and exterior of residential rental properties. The Code does NOT apply to state or federally owned buildings or land (OSU, EPA, etc)
Fourth, complainants cannot be anonymous, but can request to keep their identity confidential.
Fifth, a question that has come up is how much more will the annual fee be to cover the additional cost? The answer is none. Under the fee section of the ordinance, the fee is scheduled to increase $1 per rental unit in every odd year. Thus the next increase in the fee, from the current $13 to $14 will occur in 2017. If the City wants to change the fee, the ordinance would have to be amended, requiring public notice.

The Livability Code is very specific. I will not try to summarize all of the nuances of the Code in this email. In order to be prepared, I strongly suggest that begin reviewing the Code earlier rather than later.
