How can a foreign buyer make sure the property they are buying in Phuket is legally clean?

One of the most important steps before buying property in Phuket is proper due diligence.

A property may look perfect, but the legal side should always be checked before signing anything or paying a deposit.

For land or a villa, an independent qualified lawyer should review the title deed at the Land Office, confirm the registered owner, and check for any mortgages, leases, servitudes, or other registered encumbrances.

If a Thai company is involved, the company structure should also be reviewed carefully. Thai shareholders should be genuine shareholders, not simply holding shares on behalf of a foreign buyer.

It is also important to look beyond the shareholder list and understand the company records and ownership structure properly.

My advice is simple: do not rely only on what the seller, developer, or agent tells you.

Have an independent lawyer review the property, the ownership structure, and the documents before you commit.

A beautiful property matters - but a clean legal structure matters just as much.

One of the most overlooked questions when buying a villa in Phuket is surprisingly simple: What about the water?

It may not be the first thing buyers think about when they are looking at the pool, garden, kitchen, or view, but water can have a big impact on everyday comfort and long-term ownership.

In my latest Substack article, I look at some of the practical questions buyers should ask before committing to a villa:
• Where does the water actually come from?
• Is the pressure reliable throughout the property?
• How much water storage is available?
• Is there a filtration system, and how is it maintained?
• How much water do the pool and garden use?
• And just as importantly, where does the water go during heavy rain?

In Phuket, drainage matters just as much as supply.

A beautiful villa may look perfect on a sunny viewing day, but understanding the systems behind the property can tell you a lot about how comfortable and practical it will be to live in year-round.

These are not glamorous questions, but they are important ones.

Before buying, look beyond how the property looks and ask how it actually works.

When people view a villa in Phuket, they usually notice the obvious things first but what about the water?

How easy is it to stay fit and active while living in Phuket?

Very easy, if you build it into your lifestyle.

Phuket offers plenty of ways to stay active, from gyms, yoga and Pilates studios to Muay Thai, swimming, running, padel, cycling, and outdoor training.

And of course, having the beach and warm weather for much of the year makes it even easier to enjoy an active lifestyle outdoors.

But people often overlook one thing: location.

If your favourite gym, studio, running route or activity is thirty minutes away in traffic, you may not use it as often as you imagined.

So when choosing where to live in Phuket, think beyond the property itself.

Ask yourself what kind of lifestyle you want to maintain and whether the area makes those habits easy to keep.

A good location should not only look beautiful - it should support the way you want to live every day.

If you’re planning a move to Phuket and want help finding an area that fits your lifestyle, feel free to get in touch.

Why is it so hard to find the “perfect” villa in Phuket?

Because the more specific your lifestyle becomes, the more trade-offs begin to appear.

A villa may have the sea view you love, but be further from schools, shops, or everyday conveniences.

Another may be in a perfect location, but offer less privacy or outdoor space.

A larger plot can mean more maintenance. A newer villa may come with a higher price. A quieter hillside setting may mean more driving.

And sometimes, the property that looks perfect online feels completely different in person.

That is why finding the right villa isn't about finding something with zero compromise.
It is about understanding which compromises still feel right for your life.

The best villa should fit your:
• Daily routine
• Lifestyle
• Budget
• Location priorities
• Maintenance expectations
• Long-term plans

Sometimes buyers also discover what they truly want only after viewing a few properties - and that is completely normal.

The goal is not to find a villa that ticks every possible box.
It is to find the one where you can genuinely imagine your everyday life working well.

If you are searching for a villa in Phuket and need help narrowing down the right options, feel free to get in touch.

When buyers first start looking for a villa in Phuket, many expect the process to be quite simple.

Should you rent in Phuket before deciding to buy?

For many people moving to Phuket for the first time, renting first can be a very smart step.

It gives you time to experience the island as a resident, not just as a visitor.

The area you loved on holiday may not be the most practical for your everyday routine - and you may discover a neighbourhood that suits you even better.
Renting also helps you understand things like traffic, school runs, rainy-season conditions, local amenities, and how much space you really need.

Buying a property is a much bigger commitment, so there is nothing wrong with taking your time and learning how you actually want to live here first.

Sometimes the best property decision starts with simply living in Phuket for a while.

If you’re planning a move to Phuket and want help exploring different areas before you buy, feel free to get in touch.

Buying for yourself or buying for rental income in Phuket?

It sounds like a simple question, but it can completely change the kind of property you should be looking for.

If you are buying for yourself, you may care more about privacy, space, views, a home office, or a quiet neighbourhood.

If rental income is the main goal, you may need to think more about convenience, easy access, practical layouts, maintenance, and what future tenants or holiday guests are actually looking for.

And sometimes, the property you would personally love to live in is not necessarily the one that makes the most sense as a rental investment.

In my latest Substack article, I look at the difference between buying for lifestyle and buying for rental income - and how to think more clearly about your goals before choosing a property.

BVI & Thai Property: What Should a Buyer’s Lawyer Check? | Part 5/8

Before using a BVI or offshore company in a Thai property or business structure, one of the first questions should be:
- What exactly is the company legally allowed to do in Thailand?

In this part of the discussion, the lawyers explain that a BVI company does not automatically receive special privileges simply because it is an offshore company.

A buyer’s lawyer should first look at the structure itself, the client’s actual intention, and the legal limits that apply.

Important points include:
• What percentage can the foreign company legally hold?
• What is the client actually trying to achieve - ownership, investment, rental income, management,
development, or another business activity?
• Does the proposed structure match what Thai law allows?
• Has the offshore company obtained an FBL - Foreign Business Licence - where one is required?
• If an FBL has been granted, what exact activities does it permit?

This last point is especially important.
A Thai company may have several - registered business objectives - for example:
- Property rental
- Property management
- Buying and selling property
- Other related services

But if the FBL only approves one of those activities, the company cannot simply assume it is allowed to operate all of them.

The licence must match the actual business activity being carried out.

The discussion also highlights a common misunderstanding:
A BVI company may offer tax or financial advantages in its home jurisdiction, but that does not mean it receives extra ownership or operating rights in Thailand.

Once the structure operates here, Thai law still applies.

The key takeaway:
Before choosing a BVI structure, the investor should understand both the legal limits and the commercial purpose of the investment.

The structure should fit the business - not the other way around.

Independent legal advice at the beginning can help prevent expensive restructuring or compliance problems later.

What should expats consider when choosing where to live in Phuket?

When choosing an area in Phuket, it’s easy to focus on one thing first - usually the beach.

But everyday life here is about much more than that.

Think about what a normal Monday will look like.

- Where will you work?
- Where will your children go to school?
- Do you want to be close to supermarkets, hospitals, gyms, cafés or restaurants?
- And how much time are you comfortable spending in the car each day?

Two homes can look very similar, but the lifestyle can feel completely different depending on the location.

My advice is to spend some time in the neighbourhood before making a decision.

Visit in the morning.
See what traffic is like during busy hours.
Come back again in the evening.

You’re not only choosing a property - you’re choosing your everyday routine.

If you’re planning a move to Phuket and need help finding an area that fits your lifestyle, feel free to get in touch. I’d be happy to help you narrow down the options.
