"If I sell my telecom lease, do I lose ownership of my property?"
In a typical lease capitalisation transaction, the underlying land or building remains yours.
You retain ownership of the underlying land or building. What you are typically selling is the right to receive future rental income from the specific telecom agreement, together with the rights needed to collect that income.
Here is how the process works:
โ You keep your property: You retain ownership of the underlying land or building, subject to the rights and obligations set out in the transaction documents.
โ Options depend on the agreement: Depending on the agreement, it may be possible to capitalise part or all of the future rental income.
โ Future contractual risk transfers to TIP: Some mobile site leases allow the tenant to terminate with relatively short notice, in some cases 30 to 90 days. You receive an agreed lump-sum payment, while TIP takes on the future contractual risk associated with the lease.
โ We handle the admin: TIP manages the lease relationship with the mobile operator going forward.
Before signing any capitalisation agreement, you should always understand exactly which rights are being transferred and consult an independent legal advisor.
