To the owners at Azure:

I'm Luigi Novembre, the developer of Azure and a fellow owner, and I want to share some information with you directly.

It is my understanding that the HOA board has engaged legal counsel to pursue claims over alleged construction defects in the building. As far as I am aware, owners were not consulted before this decision was made, and many have not seen the engagement letter or been given a clear picture of the potential costs.

Why this matters to you: legal action of this kind can be expensive. If the costs exceed what is recovered, the shortfall may fall to owners through a special assessment.

I believe there is a better first step. Any legitimate concern with the building should be clearly identified and brought directly to the people who built it. I am not aware of any valid construction defect that was brought to our attention and not resolved.

I would encourage every owner to ask the board for:

• A copy of the engagement letter
• An estimate of the legal costs and who pays them
• The specific issues being alleged
• The alternatives that were considered
