Two days before closing, these buyers did their final walkthrough and found moisture in the unit, plus a few promised extras that hadn't been finished, like a pergola, a patio extension, and an EV charger. They refused to complete and called it a fundamental breach. The court disagreed. They lost their $75K deposit and were ordered to pay $140K in damages on top of it, because the developer had to resell into a market that had dropped.

MYTH OR FACT? šŸ‘€

Losing a presale deposit is the worst that can happen.

MYTH. In one BC court case, buyers who refused to close lost their $75,000 deposit and were ordered to pay another $140,000 in damages.

The reason? The developer had to resell the unit in a declining market.

Before walking away from a presale, understand the contract and the potential financial consequences.

6 buyers sued to get out of their presale contracts at Eclipse in Burnaby, and the judge ruled those contracts unenforceable. But it had nothing to do with the market dropping. The developer failed to disclose a $12M CRA judgment, suspended building permits, and expired warranty coverage, all things BC's REDMA Act says buyers have to be told. Their deposits are still in litigation, but they got to walk away from the contracts. The court protected them because they were kept in the dark.

Coquitlam is sitting on about 600 unsold new condos. That's roughly the same number as every active condo listing on the MLS right now, and inventory was already high. On top of that, condo prices in Coquitlam are down around 15% from the 2022 peak and have been sliding almost every year since. If you bought at the top or you're thinking about buying now, you need to understand what you're walking into. Click the link in bio to sign up for our Move Up Math Masterclass.

Presales in Metro Vancouver are getting absolutely roasted right now. Fewer than 400 sold in all of last year, which is about 85% below a normal year. In Q1 there were zero new concrete housing starts, compared to 152 the year before. And there are over 4,300 finished, move-in ready condos sitting unsold on developer books, up 76% from last year and the highest on record. This market is frozen, and the fallout is just getting started.

Two presale lawsuits just came out of BC courts, and they went in completely opposite directions. In one, buyers walked away from over $30M worth of contracts. In the other, a buyer tried the same thing and ended up owing the developer over $215K. Same market, same type of purchase, totally different outcomes. The difference comes down to what each side actually did. Click the link in bio to sign up for our Move Up Math Masterclass so you don't make the same mistakes these buyers made.
