🏡 Buying or selling a property by private treaty? Here’s what you need to know.

In a private treaty sale, the seller sets an asking price and buyers can make offers and negotiate the price and terms with the seller, usually through the real estate agent.

But an accepted offer does not mean the property has been legally sold. In NSW, the transaction generally becomes legally binding once contracts have been exchanged.

For buyers, this is why it’s important to understand the contract and complete your due diligence before signing and exchanging contracts.

Lodged vs Registered - what's the difference?

When it comes to property in NSW, you may hear that a document or "dealing" has been lodged with NSW Land Registry Services.

But what does that actually mean?

aling being lodged does not necessarily mean it has already been registered on title.

In simple terms, lodgment means the dealing has been submitted for registration. It may then be examined or otherwise processed before registration is completed.

Why does this matter?

📑 Lodges means the dealing has been submitted to NSW Land Registry Services for registration.
✅ Registered means the registration process has been completed and the dealing has been recorded on title.

A lodged dealing may still need to be examined or processed before registration is complete, so lodged and registered don't necessarily mean the same thing.

🔍 Why does this matter?
When buying, selling or transferring property, it's important to understand what is actually registered on the title and the current status of any dealings affecting the property.

Know what's on title. Know where your transaction stands.

This Labour Day, we’re taking a moment to recognise the people behind the work — the ones who show up, stay one step ahead, manage the moving parts and help keep things on track. 💙

In conveyancing, there’s a lot that happens behind the scenes. Every email, phone call, document, deadline and decision plays a part in getting a transaction across the line.

And behind every one of those details are people who care about getting it right.

To our team, our clients and the professionals we work alongside — thank you for the work you do every day. 🌟

This Labour Day, we celebrate the people behind the process.

👏 Happy Labour Day from World Class Conveyancing!

Thinking about bidding at auction? 🏠 Don’t let the excitement of auction day rush you into a decision.

In NSW, if you’re the successful bidder, you must sign the contract and pay the deposit on the spot (usually 10% of the purchase price) and there’s no cooling-off period.⚠️

That’s why the real work starts before you raise your paddle.

Before you bid, make sure you’ve:

✔️ Had the contract reviewed by your conveyancer
✔️ Arranged a building and pest inspection
✔️ Checked relevant property and strata information, where applicable
✔️ Confirmed your finance and borrowing capacity
✔️ Set your maximum budget, and stick to it

An auction can move quickly. Your decision shouldn’t have to.

Do your homework before auction day, so you know exactly what you’re bidding on.

Planning to bid at auction? Speak with your conveyancer before you make your move.🤙

Found your dream home? 🏡

Before the excitement takes over, take a moment to understand the Contract of Sale before signing.

In NSW, it’s recommended that you obtain a copy of the contract as early as possible and have it reviewed by a licensed conveyancer before you sign. The contract can contain important information about the property and the terms of the sale, including deposit requirements, settlement details, title information, special conditions, vendor disclosures and inclusions.

🔎 Understand what you’re agreeing to.
📝 Ask questions if something isn’t clear.
⚖️ Seek professional advice before signing.

Understand first. Sign second.

If you’re buying property in NSW, make sure you have the right advice before proceeding.

General information only. It is not legal advice and does not take into account your individual circumstances.

Buying off-the-plan means committing to a property before it has been completed. 🏗️🏠

The finished property may differ from what was originally disclosed, construction or settlement may take longer than expected, and your finance position may change during the process. NSW Government guidance recommends that buyers understand the contract and obtain legal advice before signing. ⚖️

There are also specific protections for off-the-plan purchasers in NSW, including a 10-business-day cooling-off period, increased disclosure requirements, notification of certain material changes, and protections around sunset clauses. 📑

The display suite shows you what could be. The contract tells you what you’re actually buying.

🔑 Buying off-the-plan in NSW? Have your contract reviewed by an experienced conveyancer before you commit.
